Terms and conditions of the online shop

The terms and conditions of the online shop of the Ujazdowski Castle – Centre for Contemporary Art determine the scope and conditions for the sale of goods by the Ujazdowski Castle – Centre for Contemporary Art, based in Warsaw, address: Jazdów 2, 00–467 Warsaw, Poland, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under number RIK 15/92, NIP 526-025-12-85, REGON 000986159, e-mail: wydawnictwa@u-jazdowski.pl, +48 22 628 12 71 ext. 123, via the online shop available at www.u-jazdowski.pl/en/shop.

Ujazdowski Castle – Centre for Contemporary Art is the administrator of customers’ personal data processed in connection with the sales carried out in the online shop.

 

Terms used in the terms and conditions shall mean:

  • Terms and Conditions – these terms and conditions of the online shop, referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2020, item 344, as amended), setting out the principles for the purchase of goods offered by the online shop through the website www.u-jazdowski.pl/en/shop and the principles for their complaint and return.
  • Seller – Ujazdowski Castle – Centre for Contemporary Art, with its registered office in Warsaw, address: Jazdów 2, 00–467 Warsaw, Poland, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under number RIK 15/92, NIP 526-025-12-85.
  • Shop – online shop operated via the website at: www.u-jazdowski.pl/en/shop, telephone contact: +48 22 628 12 71 ext. 123 on working days from 10:00 to 16:00; e-mail contact: wydawnictwa@u-jazdowski.pl
  • Customer – a natural person (including a consumer), a legal person or an organisational unit without legal personality, who concludes a sales contract with the Seller and accepts the Terms and Conditions.
  • Order – goods offered by the Shop, placed by the Customer in the Basket.
  • Working days – days from Monday to Friday excluding holidays.

 

§1 General information

  1. The online shop is an integral part of the Ujazdowski Castle – Centre for Contemporary Art.
  2. The administrator of the website www.u-jazdowski.pl is the Ujazdowski Castle – Centre for Contemporary Art, with its registered office in Warsaw, at 2 Jazdów Street, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under the number RIK 15/92, NIP 526-025-12-85, REGON 000986159, e-mail: wydawnictwa@u-jazdowski.pl, telephone: +48 22 628 12 71 ext. 123, hereinafter referred to as the “Ujazdowski Castle – Centre for Contemporary Art”.
  3. The Customer is obliged to read and accept the Terms and Conditions.
  4. The Customer confirms to have read these Terms and Conditions before making a purchase.
  5. Goods in the Shop are described. All prices placed next to the offered goods are given in PLN and include VAT, but do not include the cost of shipment. The final cost of an order consists of the price of the purchased goods and the delivery charge.
  6. Information on the total value of the Order including shipping costs is presented in the Order summary after the Customer has selected the delivery method.
  7. In the case of Orders placed within the framework of valid promotions, they are fulfilled taking into account the discounts resulting from the terms of the specific promotion. The Seller organises promotions in accordance with applicable laws, in particular in compliance with information obligations. 
  8. The provisions concerning the right of withdrawal and the right of complaint shall apply in situations where the Customer is a consumer. In other cases, the provisions of the Civil Code and other relevant legislation shall apply.

 

§2 Purchase rules

  1. In order to conclude a contract of sale (hereinafter: “Contract”), it is necessary for the Customer to confirm that he has read these Terms and Conditions before making a purchase.
  2. The Contract is concluded by the Customer placing an Order via www.u-jazdowski.pl/en/shop.
  3. Orders can be placed 24 hours a day, 7 days a week, but will be processed on working days between 10am and 4pm.
  4. By placing an Order, the Customer agrees to the inclusion of his/her personal data in the database of the Ujazdowski Castle – Centre for Contemporary Art and its processing for the purpose of fulfilling the Agreement. The Customer is responsible for providing false personal data.
  5. To place an Order, select the goods on the Shop website and add them to the Basket and then follow the instructions that appear.
  6. Until the button “Continue order” is pressed, the Customer has the possibility of modifying the Order.
  7. Sending a completed Order form constitutes an offer to buy and is binding on the Customer.
  8. After placing an Order, the Customer will receive an e-mail with a transaction number, confirming the registration of the transaction.
  9. The contract of sale shall be deemed concluded and binding upon delivery to the Seller of the confirmation of receipt of funds and thus acceptance of the Order. The date of delivery shall be deemed to be the date on which the message is received by the e-mail server serving the Seller’s e-mail address.
  10. Orders are processed in the order of receipt – within 3 working days of receipt of the Order.
  11. The Seller reserves the right to withdraw individual goods from the offer and to change their prices – but this does not apply to orders already accepted for processing.
  12. In the event of unavailability of a part of the goods covered by the Order, the Seller shall inform the Customer, who shall decide on the manner of fulfilment of the Order (partial fulfilment or cancellation of the whole Order).
  13. If a VAT invoice is to be issued to a Customer who is self-employed and/or a VAT payer, the relevant data and VAT ID must be provided when placing the order, which is tantamount to consenting to the issuing of a VAT invoice without signature. Each shipment is accompanied by a WZ document confirming the release of the book from the warehouse.
  14. The shop does not issue receipts.

 

§3 Payments

  1. Payment for goods ordered in the Shop is possible via the Przelewy24 website, to which the Buyer will be redirected immediately after placing the Order.
  2. The Przelewy24 website is administered by PayPro SA, with its registered office at 8 Pastelowa Street, 60–198 Poznań, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto and Wilda, VIII Economic Division of the National Court Register under KRS number 0000347935, NIP number 7792369887, with a share capital of 5,476,300 PLN, fully paid up, and in the Register of National Payment Institutions maintained by the Polish Financial Supervision Authority under UKNF number IP24/2014.   3. The moment the payment is credited is the moment the payment is recognised by Przelewy24.

 

§4 Delivery and shipping costs

  1. The Customer chooses the method of delivery of the goods in the Order form.
  2. The Shop carries out deliveries according to the price list below:
    Parcel locker 24/7 InPost– delivery within Poland – 13 PLN;
    InPost courier – delivery within Poland – 16 PLN;
    Polish Post – delivery within Poland – 20 PLN;
    Polish Post – international delivery – 50 PLN.
  3. The cost of delivery of an Order with a value of less than 200 PLN is covered by the Customer.
  4. The cost of delivery of an Order with a value above 200 PLN is covered by the Seller.
  5. It is possible to collect the Order in person at the cash desk in the main hall of the Ujazdowski Castle – Centre for Contemporary Art, 2 Jazdów Street, Warsaw, within 7 days of receiving an e-mail from the Shop confirming that the Order has been fulfilled. Opening hours:

  6. An Order not collected within 7 days of receiving the e-mail can be collected at another time, agreed with the team of the information desk and ticket office of the Ujazdowski Castle – Centre for Contemporary Art, after prior contact by e-mail: info@u-jazdowski.pl or by phone: +48 22 628 12 71 ext. 135.

 

§5 Delivery times

  1. The delivery time depends on the selected shipping option and delivery location.
  2. The Shop is not responsible for non-delivery or delayed delivery caused by the Customer providing an incorrect or inaccurate address.
  3. The Customer should check the condition of the consignment on receipt. If the packaging is damaged, Customer can refuse to accept the consignment and request a damage report from the carrier.

 

§6 Right of withdrawal

  1. A Customer who is a consumer has the right to withdraw from a distance contract of sale concluded within a period of 14 days, calculated from taking possession of the goods by the Customer or a third party other than a carrier indicated by the Customer, without giving any reason and without incurring costs, except for the costs specified in Article 33, Article 34(2) and Article 35 of the Act of 30 May 2014 on consumer rights (Journal of Laws 2023 item 2759, as amended).
  2. In order to exercise the right to withdraw from the Contract, the Customer must inform the Seller of the decision to withdraw from the Contract by an unequivocal statement (Attachment No. 1 to the Terms and Conditions) in an e-mail sent to: wydawnictwa@u-jazdowski.pl. The Shop shall immediately acknowledge the receipt of the declaration of withdrawal from the Contract in an e-mail message.
  3. The goods to be returned should be sent back to the Seller by the Customer within 14 days from the date of withdrawal from the Contract to the address: Ujazdowski Castle – Centre for Contemporary Art, Publishing Department, 2 Jazdów Street, 00–467 Warsaw, with the annotation: Return to online shop.
  4. Returned goods must not be damaged or bear any signs of use.
  5. In the event that the Customer, as a consumer, exercises her/his right to withdraw from a distance sales contract in accordance with the provisions of the Act referred to in paragraph 1 above, the Seller shall reimburse all payments received from the Customer, including the costs of delivery of the goods, immediately and in any event no later than 14 days from the day on which the Seller was informed of the decision to exercise Customer’s right of withdrawal. The Seller shall refund the payment using the same means of payment as those used by the Customer in the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer shall not incur any fees in connection with such refund. The Seller may withhold reimbursement until it has received the goods to be returned or proof of their return to the Seller’s address.
  6. The Customer shall bear the cost of packaging and returning the returned goods.
  7. The Seller does not accept cash on delivery.

 

§7 Complaints

  1. In the case of non-conformity of the goods sent to the Customer with the Agreement, the Customer may file a complaint by sending an e-mail with a filled-in Complaint Form (Annex 2 to the Terms and Conditions) to the following address: wydawnictwa@u-jazdowski.pl. The basis and scope of the Seller’s liability towards the Customer who is a consumer within the meaning of Article 221 of the Act of 23 April 1964 Civil Code (Journal of Laws 2023 item 1610 as amended) or a consumer who is an entrepreneur as referred to in Article 385 of the aforementioned Act are based on the principles contained in Chapter 5a of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023 item 2759 as amended). The concept of “goods in conformity with the contract” is contained in Article 43b of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023 item 2759 as amended).
  2. The complaint should contain the Customer’s data enabling his identification, details of the ordered goods and a precise description and indication of the reason for the complaint. The Seller shall not be liable for incorrectly made complaints, in particular for the provision of incorrect or untrue data by the Customer.
  3. The complaint will be dealt with within 14 days of receipt. Confirmation of receipt of the submission of complaint will be sent to the Customer in an e-mail message. The Ujazdowski Castle – Centre for Contemporary Art will inform the Customer about the result of the complaint processing in an e-mail sent to the address indicated in the Complaint Form within 14 days from the date of its receipt. If the complaint is related to payments made through an external website, the period for processing the complaint may be extended, of which the Seller will immediately inform the Customer in an e-mail message, indicating a new deadline for processing the complaint, but not longer than 30 days from the date of receiving the complaint. In the absence of a reply to the complaint, it shall be presumed that the complaint has been considered positively.
  4. The Seller shall not be liable for non-delivery of the Complaint Form in case the message is stopped by the anti-spam system of the mail program of the Ujazdowski Castle – Centre for Contemporary Art.
  5. If the goods do not comply with the Contract, the Customer may request a replacement. If the complaint proves to be justified, the Seller shall replace the goods within 7 days, without undue inconvenience for the Customer, taking into account the specificity of the goods and the purpose for which the Customer purchased them. The cost of the replacement, including in particular the cost of postage and courier charges, shall be borne by the Seller. The Customer is obliged to make the goods to be exchanged available to the Seller. The Seller shall collect the goods at his own expense.
  6. If the goods are not in conformity with the Contract, the Customer may request either a price reduction or withdrawal from the Contract. The Customer has this right if: The Seller fails to bring the goods into conformity with the Contract; refuses to do so; the non-conformity continues despite an attempt to bring the goods into conformity with the Contract; the non-conformity of the goods with the Contract is so significant as to justify the exercise of the right to reduce the price or withdraw from the Contract without first requiring the goods to be brought into conformity with the Contract, or if, in view of the circumstances or the Seller’s statements, it is known that the Seller does not intend to bring the goods into conformity with the Contract within a reasonable time or without undue inconvenience to the Customer.
  7. The reduced price must be in such proportion as the value of the non-conforming goods remains to the value of the contractual goods.
  8. The Seller shall reimburse to the Customer the amounts due as a result of exercising the right to reduce the price immediately, but no later than within 14 days of receiving the complaint.
  9. The Customer may not withdraw from the Contract if the lack of conformity of the goods with the Contract is immaterial.
  10. If the non-conformity concerns only some of the goods supplied under the Contract, the Customer may withdraw from the Contract only in respect of those goods and also in respect of other goods purchased by the Customer together with the non-conforming goods, if the Customer cannot reasonably be expected to agree to retain only the conforming goods.
  11. In the event of withdrawal from the Contract, the Customer shall immediately return the goods to the Seller.
  12. The Seller shall refund the price to the Customer immediately, no later than within 14 days of receipt of the goods or proof of their return to the Seller’s address.
  13. The Seller shall refund the price using the same method of payment used by the Customer, unless the Customer has agreed in the Complaint Form to a different method of refund.
  14. Consideration of a complaint by the Seller does not exclude the Customer’s right to pursue claims under the general principles of the Act of 23 April 1964 Civil Code (Journal of Laws 2023 item 1610 as amended) and the provisions of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023 item 2759 as amended).

 

§8 Protection of personal data

  1. By registering at www.u-jazdowski.pl/en/shop or by placing an Order, the Customer agrees that her/his personal data will be maintained in the database of the Ujazdowski Castle – Centre for Contemporary Art and processed for the purpose of fulfilling the Order. The Customer’s provision of personal data and consent to its processing are necessary for the fulfilment of the concluded Agreement.
  2. The Customer’s personal data are processed exclusively by the Ujazdowski Castle – Centre for Contemporary Art and are not made available to other entities.
  3. The Customer has the right to access and modify her/his data.
  4. Personal data are protected in accordance with the provisions of the Data Protection Act of 10 May 2019 (consolidated text – Journal of Laws 2019, item 1781, as amended) and the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO) against unauthorised access by third parties. §9 Final provisions

  1. In matters not covered by these Terms and Conditions, the relevant provisions of the Civil Code and other legal regulations shall apply.
  2. The provisions of the Terms and Conditions relating to consumer rights under, inter alia, the Consumer Rights Act of 30 May 2014 (Journal of Laws 2023 item 2759 as amended) do not apply to non-consumer customers.
  3. The regulations are effective from 1 March 2024.
  4. The provisions of these terms and conditions shall not apply if the applicable legal provisions shape the rights and obligations of the parties differently.
  5. The Seller reserves the right to make changes to these Terms and Conditions for important reasons, in particular: changes to the law; changes to payment and delivery methods, to the extent that the changes affect the implementation of the provisions of these Terms and Conditions.
