Online bookshop
- The Terms and Conditions of the online bookshop of the Ujazdowski Castle Centre for Contemporary Art define the scope and conditions governing the sale of goods by the Ujazdowski Castle Centre for Contemporary Art, based in Warsaw, address: Jazdów 2, 00–467 Warsaw, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under number RIK 15/92, VAT No. PL 526 025 12 85, REGON 000986159, e-mail: wydawnictwa@u-jazdowski.pl, phone: +48 22 628 12 71 ext. 123, via the online bookshop available at www.u-jazdowski.pl/en/shop.
- The controller of the Buyer’s personal data processed in connection with sales conducted through the online bookshop is the Ujazdowski Castle Centre for Contemporary Art.
The terms used in these Terms and Conditions shall mean:
- Terms and Conditions – these Terms and Conditions of the online bookshop, referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2020, item 344, as amended), specifying the rules governing the purchase of goods offered by the online bookshop via the website www.u-jazdowski.pl/en/shop and the procedures for lodging complaints and making returns.
- Seller – the Ujazdowski Castle Centre for Contemporary Art, with its registered office in Warsaw at ul. Jazdów 2, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under number RIK 15/92, VAT No. PL 526 025 12 85.
- Online Bookshop – a bookshop operated via the website www.u-jazdowski.pl/en/shop, contact: +48 22 628 12 71 ext. 123 on working days between 10:00 a.m. and 4:00 p.m.; e-mail: wydawnictwa@u-jazdowski.pl
- Bookshop – a bookshop operated by the Ujazdowski Castle Centre for Contemporary Art at its headquarters at ul. Jazdów 2, 00-467 Warsaw, open from Tuesday to Sunday from 11:00 a.m. to 7:00 p.m., and on Thursdays from 11:00 a.m. to 8:00 p.m.
- Buyer – a natural person (including a consumer), a legal person, or an organisational unit without legal personality, who, by placing an order, concludes a sales contract with the Seller and accepts the Terms and Conditions.
- Order – goods offered by the Online Bookshop, selected and placed by the Buyer in the shopping basket.
- Working days – days from Monday to Friday, excluding public holidays.
§ 1 General information
- The Online Bookshop constitutes an integral part of the Ujazdowski Castle Centre for Contemporary Art.
- The website www.u-jazdowski.pl is administered by the Ujazdowski Castle Centre for Contemporary Art, with its registered office in Warsaw at ul. Jazdów 2, entered in the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage of the Republic of Poland under number RIK 15/92, VAT No. PL 526 025 12 85, REGON 000986159, e-mail: wydawnictwa@u-jazdowski.pl, phone: +48 22 628 12 71 ext. 123, hereinafter referred to as the “Ujazdowski Castle Centre for Contemporary Art”.
- The Buyer is obliged to read and accept these Terms and Conditions.
- The Buyer confirms that they have read these Terms and Conditions prior to making a purchase.
- The goods in the Online Bookshop are described. All prices listed for goods on offer are stated in Polish zlotys and include VAT, but exclude shipping costs. The final cost of the Order consists of the price of the purchased goods and the shipping fee.
- Information on the total value of the Order, including shipping costs, is provided in the order summary once the Buyer has selected the delivery method.
- Orders placed under current promotions are processed with discounts arising from the terms and conditions of the specific promotion. The Seller organises promotions in accordance with applicable law, in particular with respect to information obligations.
- The provisions regarding the right of withdrawal and complaints apply where the Buyer is a consumer, i.e. a natural person who does not conduct business activity. In all other cases, the provisions of the Civil Code and other relevant legal regulations apply.
§ 2 Terms and conditions of purchase
- For a sales contract (hereinafter: the “Contract”) to be concluded, the Buyer must confirm that they have read these Terms and Conditions prior to making a purchase.
- The Contract is concluded when the Buyer places an Order via the website www.u-jazdowski.pl/en/shop.
- Orders may be placed 24 hours a day, 7 days a week; however, they will be processed on working days between 10:00 a.m. and 4:00 p.m.
- By placing an Order, the Buyer consents to the inclusion of their personal data in the database of the Ujazdowski Castle Centre for Contemporary Art and to the processing of such data in accordance with the applicable provisions of the GDPR for the purpose of performing the Contract. The Buyer is responsible for providing accurate personal data.
- To place an Order, select the goods on the Online Bookshop website and add them to the basket, then follow the instructions displayed.
- Up until the “Confirm order” button is activated, the Buyer may modify the Order.
- Sending the completed order form constitutes a purchase offer and is binding upon the Buyer.
- After placing the Order, the Buyer will receive an e-mail with a transaction number confirming registration of the transaction.
- The sales contract is deemed concluded and binding upon delivery to the Seller of confirmation of receipt of funds and, consequently, acceptance of the Order. The date of delivery of the message is deemed to be the date on which it is received by the e-mail server serving the Seller’s e-mail address.
- Orders are processed in the order in which they are received, within 3 working days of acceptance of the Order.
- The Seller reserves the right to withdraw individual goods from the offer and to amend their prices; however, this does not apply to Orders already accepted for processing.
- If certain goods covered by the Order are unavailable, the Seller shall inform the Buyer, who shall decide on the method of fulfilment of the Order (partial fulfilment or cancellation of the entire Order).
- A fiscal receipt or invoice is attached to each shipment.
- If a VAT invoice is to be issued to a Buyer who is a business owner and/or VAT payer, the relevant details and tax identification number must be provided when placing the Order, which is tantamount to consenting to the issue of a VAT invoice without a signature.
§ 3 Payments
- Payment for goods ordered from the Online Bookshop shall be made in Polish zlotys.
- Payment for goods ordered in the Online Bookshop may be made via the Przelewy24 website, to which the Buyer will be redirected immediately after placing the Order. Payments may be made by bank transfer from a bank account in Poland or via BLIK.
- The Przelewy24 website is administered by PayPro Spółka Akcyjna, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto i Wilda, 8th Commercial Division of the National Court Register, under KRS number 0000347935, VAT No. 7792369887, with share capital of PLN 5,476,300, paid in full, and in the register of national payment institutions maintained by the Polish Financial Supervision Authority under number UKNF IP24/2014. - The moment of payment confirmation is the moment at which payment is confirmed by Przelewy2
- Buyers who do not hold a bank account in Poland may pay for Orders placed in the Online Bookshop by bank transfer after contacting the Seller at the following e-mail address: wydawnictwa@u-jazdowski.pl. The transfer details will be provided in the reply.
§ 4 Delivery and shipping costs
- The Buyer selects the method of delivery in the order form.
- The Online Bookshop delivers within Poland according to the following price list:
InPost parcel lockers – delivery within Poland – PLN 13;
InPost courier – delivery within Poland – PLN 16;
Poczta Polska (Polish Post) – delivery within Poland – PLN 20. - The cost of delivery for orders within Poland with a value of less than PLN 200 shall be borne by the Buyer.
- The cost of delivery for orders within Poland with a value of more than PLN 200 shall be borne by the Seller.
- The cost of delivery outside Poland is determined individually following prior contact by e-mail at: wydawnictwa@u-jazdowski.pl
- Personal collection is possible at the Bookshop at the Ujazdowski Castle Centre for Contemporary Art at ul. Jazdów 2 Street in Warsaw, within 7 days of receipt of an e-mail from the Online Bookshop confirming the Order. Opening hours:

Sunday 11:00 a.m.–7:00 p.m. - Orders not collected within 7 days of receipt of the e-mail may be collected at another time agreed with the team at the Ujazdowski Castle Centre for Contemporary Art Bookshop, following prior contact by e-mail: ksiegarnia@u-jazdowski.pl.
- The Seller shall not refund the purchase price for orders not collected by the Buyer from the Bookshop at the Ujazdowski Castle Centre for Contemporary Art within 100 days of the order date. Uncollected goods shall be returned to the Seller’s warehouse.
§ 5 Delivery times
- The delivery time depends on the selected shipping option and the place of delivery.
- The Online Bookshop is not responsible for non-delivery or delayed delivery resulting from the Buyer providing an incorrect or inaccurate address.
- The Buyer should check the condition of the parcel upon delivery. If the packaging is damaged, they may refuse to accept it and request that the supplier draw up a damage report.
§ 6 Right to withdraw from the contract
- The Buyer, being a consumer, has the right to withdraw from a distance sales contract within 30 days from the moment the Buyer, or a third party other than the carrier indicated by the Buyer, takes possession of the goods, without giving any reason and without incurring any costs, except for the costs specified in Article 33, Article 34(2) and Article 35 of the Act of 30 May 2014 on consumer rights (Journal of Laws 2023, item 2759, as amended).
- To exercise the right to withdraw from the contract, the Buyer must inform the Seller of their decision to withdraw by means of an unequivocal statement (Appendix 1 to the Terms and Conditions) sent by e-mail to: wydawnictwa@u-jazdowski.pl. The Seller shall immediately confirm receipt of the statement of withdrawal by e-mail.
- The Buyer should return the goods to the Seller within 14 days of withdrawing from the contract, to the following address: Ujazdowski Castle Centre for Contemporary Art, Publishing Department, ul. Jazdów 2, 00–467 Warsaw, marked: Return to the online bookshop.
- Returned goods must not be damaged or show signs of use.
- If the Buyer, as a consumer, exercises their right to withdraw from a distance sales contract in accordance with the Act referred to in paragraph 1 above, the Seller shall refund all payments received from the Buyer, including delivery costs, without delay and in any event no later than 14 days from the date on which the Seller receives the returned goods. Refunds shall be made using the same means of payment as used by the Buyer in the original transaction, unless the Buyer has expressly agreed otherwise; in any case, the Buyer shall not incur any fees in connection with the refund. The Seller may withhold the refund until the returned goods or proof of their return to the Seller’s address is received.
- The cost of packaging and returning the goods to the Seller shall be borne by the Buyer.
- The Seller does not accept cash-on-delivery parcels.
§ 7 Complaints
- In the event of non-conformity of the goods delivered to the Buyer, the Buyer may submit a complaint by sending an e-mail with a completed complaint form (Appendix 2 to the Regulations) to: wydawnictwa@u-jazdowski.pl. The basis and scope of the Seller’s liability towards a Buyer who is a consumer within the meaning of Article 221 of the Act of 23 April 1964 – The Civil Code (Journal of Laws 2023, item 1610, as amended) or a consumer who is an entrepreneur referred to in Article 385⁵ of the above-mentioned Act, are governed by Chapter 5a of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023, item 2759, as amended). The concept of “goods in conformity with the contract” is set out in Article 43b of that Act.
- The complaint should contain the Buyer’s details enabling their identification, details of the goods ordered, and a precise description and indication of the reason for the complaint. The Seller shall not be liable for incorrectly submitted complaints, in particular where the Buyer provides incorrect or false information.
- The complaint will be considered within 14 days of receipt. Confirmation of receipt of the complaint will be sent to the Buyer by e-mail. The Ujazdowski Castle Centre for Contemporary Art will inform the Buyer of the outcome of the complaint in an e-mail sent to the address provided in the complaint form within 14 days of receipt. If the complaint concerns payments made through an external website, the period for considering the complaint may be extended, of which the Seller shall immediately inform the Buyer by e-mail, indicating a new deadline, not exceeding 30 days from the date of receipt of the complaint. If no response is provided, the complaint is deemed to have been accepted.
- The Seller shall not be liable for non-delivery of the complaint in the event that the message is blocked by the anti-spam system of the e-mail software of the Ujazdowski Castle Centre for Contemporary Art.
- If the goods are not in conformity with the Contract, the Buyer may request their replacement. If the complaint proves justified, the Seller shall replace the goods within 7 days, without undue inconvenience to the Buyer, taking into account the specific nature of the goods and the purpose for which they were purchased. Replacement costs, including postal and courier fees, shall be borne by the Seller. The Buyer is obliged to make the goods available for replacement. The Seller shall collect the goods at its own expense.
- If the goods are not in conformity with the contract, the Buyer may request a price reduction or withdraw from the contract. The Buyer is entitled to do so if: the Seller fails to bring the goods into conformity with the contract; refuses to do so; the non-conformity persists despite attempts to remedy it; the non-conformity is so significant as to justify a price reduction or withdrawal without first requesting conformity; or if, due to circumstances or the Seller’s statements, it is clear that conformity will not be ensured within a reasonable time or without undue inconvenience to the Buyer.
- The reduced price must be proportionate to the price resulting from the Contract, in the same proportion as the value of the goods not in conformity with the Contract bears to the value of goods in conformity with the Contract.
- The Seller shall reimburse the Buyer any amounts due as a result of a price reduction immediately, and no later than within 14 days from the date of receipt of the complaint.
- The Buyer may not withdraw from the Contract if the non-conformity of the goods is insignificant.
- If the non-conformity relates only to some of the goods delivered, the Buyer may withdraw from the Contract only in respect of those goods, as well as any other goods purchased together with them, if it cannot be reasonably expected that the Buyer would agree to keep only the goods in conformity with the Contract.
- In the event of withdrawal from the Contract, the Buyer shall return the goods to the Seller without delay.
- The Seller shall refund the value of the returned goods without delay, no later than within 14 days from the date of receipt of the goods or proof of their return to the Seller’s address.
- The Seller shall make refunds using the same means of payment as used by the Buyer, unless the Buyer has agreed to a different method in the complaint.
- The Seller’s consideration of the complaint does not exclude the Buyer’s right to pursue claims under the general provisions of the Act of 23 April 1964 – The Civil Code (Journal of Laws 2023, item 1610, as amended) and the provisions of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023, item 2759, as amended).
§ 8 Protection of personal data
- By registering on the website www.u-jazdowski.pl/en/shop or placing an order, the Buyer agrees to the inclusion of their personal data in the database of the Ujazdowski Castle Centre for Contemporary Art and to its processing for the purpose of fulfilling the order. The provision of personal data by the Buyer and consent to its processing are necessary for the performance of the Contract.
- The Buyer’s personal data is processed exclusively by the Ujazdowski Castle Centre for Contemporary Art and is not disclosed to other entities.
- The Ordering Party has the right to access and amend their data.
- Personal data is protected in accordance with the provisions of the Personal Data Protection Act of 10 May 2019 (consolidated text – Journal of Laws 2019, item 1781, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), against access by unauthorised third parties. § 9 Final provisions
- In matters not covered by these Terms and Conditions, the relevant provisions of the Civil Code and other applicable legal provisions shall apply.
- The provisions of these Terms and Conditions relating to consumer rights arising, among others, from the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2023, item 2759, as amended), shall not apply to customers who are not consumers.
- These Terms and Conditions shall enter into force on 1 December 2025.
- The provisions of these Terms and Conditions shall not apply if applicable legal provisions regulate the rights and obligations of the parties differently.
- The Seller reserves the right to amend these Terms and Conditions for important reasons, in particular: changes in the law; changes in payment and delivery methods, insofar as such changes affect the implementation of the provisions of these Terms and Conditions.
